Here’s a detailed list of special purpose NOCs (No Objection Certificates) required for development, as per Appendix III of the DCPR 2034:
- Airport: Required for the height of buildings as per the provisions of Regulation No 45(f)1. It’s also specifically mentioned for areas depicted in red color on Colour Coded Zoning Maps (CCZM) prepared by the Airport Authority of India (AAI)2.
- Police Authority: Necessary for the construction of Religious Structures3.
- Jail Authority: Required by the Competent Authority and as notified by the Urban Development Department, Government of Maharashtra (GoM)4.
- Railway: An NOC is insisted upon if the building is situated within 30 m from the Railway Track Boundary before granting the Commencement Certificate for the proposed building55. This is to ensure development complies with terms and conditions stipulated by the Railway Authority6. No NOC is required if construction is beyond 30m from the railway track boundary, provided no part of the building projects within this 30m limit7.
- Defence: Required by the Defence Authority around defence installations and as notified by the Urban Development Department, GoM8.
- MHCC (Mumbai Heritage Conservation Committee): Required for development related to Heritage Structures and in Heritage Precincts as specified in Regulation No 529. This is particularly crucial for changes, repairs, additions, alterations, and renovations to listed religious buildings to ensure consonance with original structure and architecture10.
- ASI (Archaeological Survey of India): Required as notified by the Competent Authority11.
- MHADA / MBRR Board (Maharashtra Housing and Area Development Authority / Mumbai Building Repairs and Reconstruction Board): Required in case of development of lands belonging to MHADA, development in MHADA layout, or for Cessed Buildings12. This is crucial for redevelopment under Regulation 33(7) (cessed buildings) and 33(5) (MHADA schemes)13.
- MCZMA (Coastal Regulation Zone Management Authority): Required for development in areas affected by Coastal Regulation Zone14. Development within CRZ areas is governed by specific MoEF notifications15.
- MoEF (Ministry of Environment and Forest): Required for development attracting the Environment Impact Assessment (EIA) Notification16. Compliance with EIA Notification No.S.O.1533 is necessary17.
- Highway: Required for plots falling within highway buffer as shown on the Development Plan (DP)18.
- MMRDA (Mumbai Metropolitan Region Development Authority): Required in the influence zone of Metro/Monorail as may be notified by the Competent Authority19.
- Estate Department of MCGM: Required for Land of Improvement Trust20.
- Collector: Required for Government land/Natural Areas (NA)/Urban Land Ceiling (ULC) wherever applicable21.
- Director of Industries: Required as specified in these Regulations22. This applies to industrial uses (Regulation 18(k)), and specifically for IT/ITES units (Regulation 33(13)) and Smart Fin Tech Centres (Regulation 33(13)(A))23232323232323.
This list can be amended by the Government of Maharashtra from time to time through additions or deletions24.
